Promotion Terms and Conditions

The following terms and conditions apply for the List With Us to Win $100,000 promotion (the “Competition”). By signing an entry in the Competition, persons warrant that they agree to be bound by and have read and understood these terms and conditions.

Conditions and Eligibility requirements for entering into the Competition:

1. To be eligible to enter into this Competition you must be over the age of 18 years. Proof of identity may be required.
2. Entrants must be Australian residents.
3. Entrants over the age of 18 will receive an entry form when they list their house for sale with Pestana Realty for a minimum period of sixty (60) days and pay a standard marketing fee. 
4. To be a valid entry, the entry form must be fully completed by including the entrant’s full name, address, email address and phone number. 
5. Information on how to enter forms part of these conditions of entry.
6. Employees and their Immediate Family of Pestana Realty Pty Ltd are ineligible to enter the competition. “Immediate Family” means any of the following:
spouse, ex-spouse, de-facto spouse, child or step child (whether by law or by adoption), parent, step-parent, grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
7. Multiple entries will be accepted if multiple properties are listed but a separate and valid entry form must be completed for each property.

Terms and Conditions:

1. Participation in this promotion is deemed acceptance of these terms and conditions and all entries must comply with these Terms and Conditions to be valid. The promoter of this Competition is Pestana Realty Pty Ltd ACN 2906927838 care of 67 Springwood Road, Springwood, Qld 4127 (“Promoter”).
2. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity and residency status) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
3. Details from entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties) and for promotional purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, for the purpose of this promotion. Entrants may access, change and/or update their personal  information and obtain a copy of the Promoter’s privacy policy here
4. The Promoter will not be liable for any loss (including without limitation, indirect, consequential or indirect loss), cost or damage, personal injury or death which is suffered (whether or not due to the negligence of any person) in connection with entering this promotion or using the prize, except any liability which cannot be excluded by law (and if so, that liability is limited to the minimum allowable by law).
5. The Promoter may cancel, suspend or vary the competition if for any reason it is not capable of being conducted as planned.
6. Prizes are non negotiable, non transferable nor can they be exchanged.
If the Prize Winner does not take a part in the second draw at the time and place set by the Promoter, the Prize Winner will forfeit the opportunity to participate in the
second draw. The Promoter accepts no responsibility for changes in prize value.

Closing and drawing dates:

1.    This competition commences on 1 July 2010 at 7.00am AEST. Entries close on 15 June 2011 at 5pm AEST.
2.    The competition runs for a period of 12 months with bi monthly draws for the chance to win $100,000 at each of the draws. Six (6) draws in total.

4.    One entry will be drawn at 10am AEST at Pestana Realty Head Office on the second last Saturday of every bi month (every second month), the December draws will be brought forward by one (1) week due to the Christmas holidays. The Promoter’s decision is final and the Promoter will not enter into any correspondence regarding the result.
5.    The entrant selected will be notified by telephone within 3 days of being drawn (Prize Winner).
6.    The Prize Winner will be required to attend Pestana Realty located at unit 67 Springwood Road Springwood, QLD 4127, on the last Saturday of every bi month (second month) at 10am where the Prize Winner will have the opportunity to draw one of 100 envelopes. Of the 100 envelopes one will contain a card marked “$100,000.00”. The other 99 envelopes will each contain cards marked “$1,000.00”. The Prize Winner will win the value written on the card contained in the envelope they select.
7.    The Prize Winner agrees, at the Promoter’s request, to participate in any promotional activity regarding their win and consent to their name and/or image and the property image being used in all media and promotional material worldwide and the Prize Winner will not be entitle to any fee for such use.
8.     The prize consists of a chance to win up to $100,000.00 AUS. The monetary amounts on offer range between $1,000.00 and $100,000.00. The potential total prize value is up to $600,000.00.
9.    Any prize money will be paid to the Prize Winner by cheque.
